Article 1. Fire Prevention Code

The International Fire Code, 2012 Edition, as published by the International Code Council is hereby adopted and incorporated by reference as the Fire Code of the City of South Hutchinson, Kansas; regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life and property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefore; as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the said International Fire Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in this Article. Such incorporation is authorized by K.S.A. 12-3009 through K.S.A. 12-3012 inclusive, and K.S.A. 12-3301 and K.S.A. 12-3302, all as amended. No fewer than three copies of said International Fire Code, 2012 Edition, as published by the International Code Council shall be marked or stamped “Official Copy, as incorporated by the Code of the City of South Hutchinson, Kansas,” with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of this article or the adopting ordinance and filed with the City Clerk to be open for inspection and to be available to the public at all reasonable business hours.

Section F-101.1 is hereby amended to read as follows:

These regulations shall be known as the Fire Code of the City of South Hutchinson, Kansas, hereinafter referred to as “this code.”

Section 111.4: Insert fines of not less than $25.00 or more than $100.00.

(a)   Purpose. The purpose of this section is to protect public infrastructure and promote public safety by prohibiting fires in close proximity to bridges within the city.

(b)   Prohibition. It shall be unlawful for any person to start, ignite, or maintain any open fire, including but not limited: to recreational fires, bonfires, burn barrels, or any other type of combustion-based flame, within 1,000 feet of any bridge located within the city.

(c)   Exceptions. This section shall not apply to:

(1)   Fires conducted or authorized by a governmental agency for training or infrastructure maintenance;

(2)   Fires used for cooking on commercially manufactured grills or smokers, provided they are not located within 100 feet of a bridge;

(3)   Fires expressly permitted in writing by the South Hutchinson Fire Department following inspection and written approval.

(d)   Enforcement and Penalty. A violation of this section is a Class C misdemeanor. Any person convicted of a violation shall be punished by a fine not to exceed $500, imprisonment in the county jail for a term not to exceed 30 days, or both such fine and imprisonment.

(e)   Distance Measurement. For purposes of this section, distance shall be measured from the outermost structural edge of the bridge to the location of the fire in a straight line (“as the crow flies”).
