A CHARTER ORDINANCE EXEMPTING THE CITY OF MAIZE, SEDGWICK COUNTY, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-1651, PROVIDING SUBSTITUTE PROVISIONS REGARDING THE DESIGNATION OF THE OFFICIAL CITY NEWSPAPER.

RECITALS

The City of Maize, Kansas (the “City”), is a city duly organized and existing under the laws of the State of Kansas; and

Pursuant to Article 12, Section 5 of the Constitution of the State of Kansas, cities are empowered to charter out from enactments of the legislature that are not uniformly applicable to all cities and that apply to the City that is chartering out from the enactments of the legislature; and

K.S.A. 12-1651 applies to the City, and its provisions are not uniformly applicable to all cities; and

The Governing Body of the City has determined that it is in the best interests of the City to exempt the City from the provisions of K.S.A. 12-1651 and to provide substitute provisions for the provisions of K.S.A. 12-1651.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MAIZE, SEDGWICK COUNTY, KANSAS:

SECTION 1.  Inapplicability.  The City, by virtue of powers vested in Article 12, Section 5 of the Constitution of the State of Kansas, elects to exempt the City from the provisions of K.S.A. 12-1651.

SECTION 2.  Substitute Provisions.  The Governing Body of the City by resolution duly passed will designate an official city newspaper that is either the Maize, Kansas website, www.maizeks.gov or is a printed newspaper that is published at least weekly 50 times a year in Sedgwick County, Kansas that has a general paid circulation on a daily, weekly, monthly or yearly basis, and cannot be a trade, religious or fraternal publication. The Official City Newspaper once designated will be the official city newspaper until the Governing Body designates a different official city newspaper by resolution duly passed.
