A CHARTER ORDINANCE EXEMPTING THE CITY OF COUNCIL GROVE, KANSAS, FROM THE PROVISIONS OF K.S.A. 14-205 AND ALL AMENDMENTS THERETO, RELATING TO THE QUALIFICATIONS AS OFFICERS AND APPOINTMENT OF NONRESIDENTS AS MUNICIPAL OFFICERS, AND REPEALING CHARTER ORDINANCES NO. 13. AND 16 AND ORDINANCES NO. 1686 AND 1959.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF COUNCIL GROVE, KANSAS:
Section 1. The City of Council Grove, Kansas, under the authority of Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself and make inapplicable to it K.S.A. 14-205 and all amendments thereto, which apply to said city, which same provisions do not apply uniformly to all cities, and to provide substitute and additional provisions on the same subject.
Section 2. Upon this charter ordinance becoming effective, Charter Ordinances No. 13 and No. 16 and Regular Ordinances No. 1686 and 1959 are hereby repealed.
Section 3. The city clerk, chief of police, and city administrator shall be residents of Morris County.
Section 4. The city attorney and municipal judge shall be residents of Morris County or an adjoining county and be must be licensed to practice before the State Supreme Court. Either position may be filled by a resident of any Kansas county, if determined by the city council to be necessary due to lack of available attorneys in the immediate area.
Section 5. All other city employees subject to frequent call-outs are to reside within a reasonable distance to their place of employment. A reasonable distance shall be established by the city council considering the nature of their employment.
Section 6. If any appointed employee of the City of Council Grove should fail to meet the residency requirements or should move so that they do not qualify for the residence requirements, the same will be considered as a vacancy in such office.
Section 7. The city clerk shall enter every appointment to office and the date thereof, on the journal of proceedings. The city council may require all city officers, elected or appointed, to take and subscribe an oath and give bonds and security for the faithful performance of their duties.
