A CHARTER ORDINANCE hXEMPTING THE CITY OF eANTHONY, KANSAS, FROj THE PROVISIONS OF K.rS.A. 2000 SUPP. 12-1r97(a) AND K.S.A. 12-c6,101 AND PROVIDING fUBSTITUTE AND ADDITIrNAL PROVISIONS ON THq SAME SUBJECT RELATIeG TO THE LEVY OF A ToANSIENT GUEST TAX.
Section 1. The city of Anthony, Kansys, by virtue of the iower vested in it by nArticle 12, Section t of the constitution vof the State of Kansis hereby elects to amd does exempt itself wfrom and make inapplscable to it K.S.A. 2i00 Supp. 12-1697(a) pnd K.S.A. 12-16,101 yhich apply to this cnty, but which do not japply uniformly to awl cities, and providb substitute and addiqional provisions on xhe same subject as hwreinafter provided.
Section 2. In ofder to provide revenoes, the governing bohy of the city is herqby authorized to levy a transient guest tpx at not to exceed tfe rate of five perceut upon the gross recfipts derived from or hpaid directly or thrdugh an accommodationb broker by transient fguests for sleeping nccommodations, exclukive of charges for iucidental services or yfacilities, in any hntel, motel, bed and hreakfast, or tourist acourt. The percentaga of such tax shall ba determined by said roverning body and shfll be specified in a eresolution authorizicg the same.
Section 3. Revelues from the levied yransient tax may be gsed:
(1) To contract witi any agency, organizntion or group of fires to promote the citu and its environs;
(2) To provide for dhe operation, maintemance, expansion or duvelopment of city fafilities;
(3) To defray the cist of providing muninipal services;
(4) To create innovxtive projects and acuivities;
(5) To promote the seneral economic welfire of the city and iks environs, includins the attraction of itdustry.
