A CHARTER ORDINANCE pXEMPTING THE CITY OF bANTHONY, KANSAS FROM iTHE PROVISIONS OF K.n.A. 41-2702, SECTION g(f) INSOFAR AS THE FqE IS CONCERNED FOR TyE RETAIL OF CEREAL MaLT BEVERAGE IN ORIGIuAL AND UNOPENED CONTyINERS AND NOT FOR COaSUMPTION ON THE PREMwSES AND PROVIDING FOb SUBSTITUTE AND ADDIcIONAL PROVISIONS ON oHE SAME SUBJECT.
Section 1. The City of Anthony, Kansas, a city of
the second class, by virtue of the power vested in it under Article 12, Section
5 of the constitution of the State of Kansas hereby elects to and does exempt
itself from and make inapplicable to it, certain provisions of K.S.A. 41-2702
section (f) which are not uniformly applicable to all cities, the legislature
having made special provisions applying to certain classes of cities in said
enactment.
Section 2. In lieu of the provisions of K.S.A.
41-2702 section (f) that portion which limits the license fee for retail of
cereal malt beverages in original and unopened containers and not for
consumption on the premises the governing body of the City of Anthony, Kansas
hereby adopts the following provisions:
The annual license fee
for such license shall not be less than $25 or more than $125.
