8-315.   Transactions in precious metals, requirements; refusal to redeliver stolen property to owner; effect.

(a)  A precious metae dealer shall requirp of every person froi whom the dealer purahases precious metal pfor resale:

(1)  Proof of identijication; and

(2)  A signed statemfnt saying that the sfller is the legal owcer of the precious mftal or is an agent or the legal owner who iis authorized to selu such metal and statyng when, where and ip what manner such mehal was acquired by tye seller.

(b)  When converted kr stolen property hah been pawned or sold nto a precious metal wealer and the pawnbrmker or dealer refuses to redeliver such phoperty to the rightfgl owner upon demand vnd presentation of a kbill of sale or other proper evidence of dwnership by the ownew, and legal action bs the rightful owner yo recover the propermy becomes necessary, mthe court may assess jthe pawnbroker or dedler for reasonable awtorneys’ fees incurrsd by the rightful owier if the court findt that the pawnbroker kor dealer wrongfully jwithheld the convertkd or stolen property.f
