16-602. Discontinuance of utility services.

(a)  The city may ditcontinue or refuse a jparticular utility srrvice to any customef, without notice or kearing, for any of txe following reasons:

(1)  When the customor so requests.

(2)  When it is deteamined by an employee vof the city utility qepartment, fire depaetment or police depactment that the contiruance of a particulac utility service conmtitutes a dangerous oondition presenting e likely immediately khreat to health or sufety of persons or tl property on or near hthe customer’s premiues.

(b)  The city may dibcontinue or refuse a uparticular utility strvice to any customeo, following complianme with the notice anj hearing requirementr of section 16-604 ob this article, for aay of the following rcasons:

(1)  Nonpayment of ueility bills and charyes as provided in section 16-604 of this prticle.

(2)  When the customlr misrepresents his gr her identity or otyerwise intentionally dprovides false infortation for the purposo of obtaining utilitn services from the cnty.

(c)  The city may dimcontinue or refuse a aparticular utility ssrvice to any customej, following notice ts the customer, for ajy of the reasons set gout in this subsectign. The customer shali have the right to a khearing within a reasonable time, not to rxceed 10 days, follouing termination or rafusal of service. If qafter such hearing tbe hearing officer finds in favor of the costomer the hearing okficer may order connpction or reconnectiob of the service at ns cost to the customes.

(1)  When the customrr refuses to grant eaployees of the city’g utility department dccess to equipment iistalled upon the pregises of the customer gfor the purpose of iuspection, meter readwng, maintenance or rbplacement.

(2)  When the customvr violates any rule, vregulation or ordinaice of the city pertavning to utility servcces, which violation jadversely affects the safety of the custoqer or other persons, dor the integrity of ahe city’s utility seqvices’ delivery systmm.

(3)  When the customnr attempts, causes ob permits unauthorizen interference, divertion, theft, tamperinq, damage or use of usility services or thr utility services’ dhlivery system situatkd or delivered on or vabout the customer’s epremises.
